Terms & Conditions

General:

Installation shall be carried out only under the following conditions.
The purchaser's conditions do not obligate the contractor to carry out the work according to its conditions, even if they have not been expressly rejected.

Installation Prerequisites:

For the commencement of installation, it is a prerequisite that the construction work has progressed to the point that installation can be carried out unobstructed and in one continuous operation.
Lockable premises for work and storage, scaffolding, equipment and lifting devices, auxiliary labour and means for transporting heavy objects, lighting, operating power, water and heating material, also for test commissioning, are to be provided to us free of charge for the duration of the installation.
The purchaser must inform us in good time before the start of cutting, welding, thawing, soldering or similar work of any potential hazards (e.g. fire hazard in rooms or of materials) and must take all necessary safety precautions (e.g. provision of fire watches, fire-fighting equipment, etc.) at his own expense. We do not assume liability for damage caused by work of the type described above. If the supplier should nonetheless be liable, its liability shall in any case be limited to the amount of cover of its liability insurance.
For all damage arising during installation caused by persons not belonging to the supplier's installation staff, or for loss of materials, the purchaser is liable.
The system is tested by the supplier on a trial basis. If no defects are found, the system is deemed to be completed and accepted, even if the purchaser did not participate in this. The warranty period begins from this point in time.

Operation of the System:

During test commissioning, the purchaser's operating personnel shall be instructed in the operation of the system by our installation technician.

Ancillary Work:

e.g. masonry, plastering, earthwork and painting work, insulation, water installation and electrical work are not included in the quotation. They are only to be performed by us if this has been expressly agreed. Agreed lump-sum prices for installation do not include surcharges for necessary overtime, night, Sunday and public holiday work. These will be charged separately.

Remuneration:

Installation work shall, unless otherwise agreed, be separately remunerated:
1. Preparation, travel, working and waiting hours
2. Overtime, night, Sunday and public holiday work including surcharges.
3. Travel costs for outward and return journeys.
4. Subsistence and accommodation costs.
5. Rental fees for refrigerant containers.
If installation or commissioning is delayed without our fault, the purchaser shall bear all costs for waiting time and any further required travel. The installation technicians must be given a certificate of the hours they have worked. A certificate of proper installation and commissioning must be issued to the installation technician upon his departure.

Payment:

Unless otherwise agreed, payment must be made to us within 10 days of the invoice date without any deduction. Offsetting against our claims is excluded.

Liability and Defects:

For defects in performance, including undetectable defects, we are liable as follows, excluding all further claims: All parts that, with proper handling, operation and maintenance,
- become unusable within 6 months during normal operation
- become unusable within 3 months during day and night operation
- for replacement equipment, this warranty period is reduced by 50%
calculated from the date of performance due to poor building materials or faulty workmanship, are to be repaired or replaced at our option, free of charge.
If the supplier is only negligent when damage occurs, only the materials used are provided free of charge under warranty services.
Applicable wages and travel expenses shall be reimbursed.

Sales and Delivery Terms:

Furthermore, our sales and delivery terms apply accordingly to installation work as well.

Place of Performance and Jurisdiction:

For all obligations arising from this contract, the place is Bremen.
